Kahnawake Gambling Jurisdiction

Located in Quebec, Canada, the Mohawk Territory of Kahnawake is an Indian reserve spanning just over 8,000 individuals. The reserve covers an area of approximately 48.05 square kilometers and is one of the eight Kanien (’kehá:ka) territories within the Mohawk Nation. Throughout history, the Kahnawake people have engaged in diplomacy with the French and British, enduring challenges such as their involvement in the War of 1812 and the effects of the 1876 Indian Act.

When the gambling industry transitioned to the online realm, Kahnawake swiftly recognized its potential and emerged as one of the pioneering regions in this domain. As a result, it became one of the earliest gambling jurisdictions, housing the esteemed Kahnawake Gaming Commission. The Commission’s primary role involves providing gaming licenses to various online gambling establishments, including online casinos, poker rooms, sportsbooks, and more.

Obtaining an online gambling license from the Kahnawake Gaming Commission necessitates strict adherence to the Commission’s stringent provisions and regulations.

Kahnawake Gambling License Benefits

Obtaining an online gambling license from the Kahnawake Gaming Commission provides numerous benefits, making it a top choice for both established and emerging gambling companies. Here are some of the advantages associated with a Kahnawake online gambling license:

  1. Speed: While not as rapid as obtaining a license in Curacao, a Kahnawake license can still be acquired within a relatively short timeframe. The application process typically takes 4-6 weeks, with approval taking an additional 6-8 weeks. This makes Kahnawake one of the quickest jurisdictions for obtaining an online gambling license, subject to timely submission of required documentation and compliance with the requirements.
  2. Simplicity: The paperwork involved in obtaining an online gambling license in Kahnawake is comparatively less burdensome than in other jurisdictions. Although there are still tasks to complete, such as questionnaires and supporting documents, the requirements are generally less onerous than those of Curacao. By enlisting the assistance of Szilaghi Consulting, the process can be further streamlined, reducing stress for applicants.
  3. Credibility for players: Kahnawake is a trusted jurisdiction, and the Kahnawake Gaming Commission is highly respected. Holding a Kahnawake gaming license signifies a commitment to responsible and fair gaming practices and ensures the absence of fraudulent activities. The commission actively monitors and supervises licensees, reviewing user complaints and taking action against companies that violate regulations. The dedication to regulatory efforts has resulted in a high level of player protection and instills trust among players and business partners.
  4. Excellent for startups or small gaming businesses: Due to the aforementioned benefits and profitability, a Kahnawake online gambling license is highly recommended for startups or small companies. By reinvesting profits into the business instead of paying significant taxes and fees, companies can focus on expansion, growth, marketing, and the integration of new games.
  5. Zero Tax: Holders of a Kahnawake gaming license enjoy a 0% fee on all gross gaming revenue. This allows companies to keep expenses low and prioritize reinvesting revenue and profit into expanding the business.
  6. Reduced application fees: The application fees for a Kahnawake betting license are among the lowest in the industry, making it accessible to many startups and small companies. While not as low as Curacao, the fees are still reasonable and allow a larger portion of capital to be invested in the product rather than administrative processes. Compared to jurisdictions like Malta or other European counterparts, Kahnawake offers a comprehensive and reputable license at a more affordable cost.

The Kahnawake Gaming Commission

Established on June 10th, 1996, the Kahnawake Gaming Commission was made possible by the adoption of the Kahnawake Gaming Law (MCR No. 26 / 1996-97) by the Mohawk Council of Kahnawake.

On July 8th, 1999, the Commission implemented its regulations pertaining to Interactive Gaming, marking its initial foray into licensing and regulating online gambling entities from around the globe.

As a regulatory body, the Kahnawake Gaming Commission is responsible for granting online gambling licenses to organizations operating in the online gambling industry. Additionally, the Commission has issued gambling licenses to three brick-and-mortar poker rooms situated within Kahnawake.

Comprising three members, each serving a two-year term, the Kahnawake Gaming Commission appoints its members through the Mohawk Council of Kahnawake.

Kahnawake Types of Licenses

Currently, the Kahnawake Gaming Commission issues four different types of licenses. The license is issued as per the Regulations for Interactive Gaming that the Commission laid down in July 1999. The most recent amendment was on June 2, 2010.

The Four Different Types of Licenses That the Kahnawake Gaming Commission Grants are:

  • Client Provider Authorization (CPA) – Issued to an entity that wishes to provide online gaming from an approved Kahnawake hosting facility. The holder of the license may offer any type of gaming they desire, including casino, sportsbook, and poker.
  • Key Person License (KPL) – This license is for individuals who hold key positions within an online gaming company, such as executives, directors, and management personnel.
  • Interactive Gaming License (IGC) – The commission only grants such a license to an approved hosting facility located in the Kahnawake domain. Since 1999, Mohawk Internet Technologies has held this license.
  • Inter-jurisdictional Authorization – This license is requested by a Company that holds a gambling license in another jurisdiction. Once obtained, the licensee may locate personnel or equipment on Mohawk territory in Kahnawake. The original licensing jurisdiction, however, is still responsible for monitoring the company.

It’s important to note that the requirements for each type of license may vary, and operators should carefully review the application process and regulatory requirements for each license type before applying. Additionally, operators are required to hold multiple licenses depending on the specific services they offer and the jurisdictions they operate in.

The application process

To obtain a Kahnawake gambling license, operators must meet several requirements and comply with strict regulations set out by the Kahnawake Gaming Commission. These are the key conditions:

  • Fit and proper person test – Applicants must undergo a fit and proper person test, which includes a background check and evaluation of their financial stability, integrity, and business experience.
  • Business plan – Applicants must submit a comprehensive business plan, outlining their proposed operations, financial projections, and marketing strategy.
  • Technical requirements – Operators must meet specific technical requirements related to their online gaming platform, such as data protection, game fairness, and player security.
  • Compliance requirements – Operators must comply with strict anti-money laundering and anti-fraud regulations, and implement responsible gaming measures.
  • Financial requirements – Applicants must have adequate financial resources to support their operations. Including maintaining a minimum amount of capital and providing financial guarantees.
  • License fees – Operators must pay a license application fee, an annual renewal fees and a percentage of their gross revenue.

The Kahnawake Gaming Commission has strict enforcement powers and regularly conducts audits and inspections to ensure compliance with their regulations. Non-compliance can result in fines, license revocation, and even criminal prosecution. Therefore, it’s important that operators fully understand and comply with all the conditions of the license.

Cost of Kahnawake Gambling License

The expenses associated with obtaining a Kahnawake gambling license can differ based on the type of license and the operator’s circumstances. Typically, the license application fee amounts to approximately $25,000 USD, which is payable upon submitting the application. Additionally, operators are obligated to pay an annual license fee ranging from $10,000 to $50,000 USD.

License holders are also required to allocate a percentage of their gross gaming revenue (GGR) to the Kahnawake Gaming Commission. The GGR fee falls within the range of 0.5% to 1.5%, contingent upon the license type and the operator’s annual revenue.

It is important to note that these fees are subject to potential modifications and may vary depending on the specific requirements of each applicant. Moreover, there might be supplementary expenses related to meeting technical and compliance prerequisites, such as software development and third-party audits.

Overall, obtaining a Kahnawake gambling license entails a significant investment for operators, necessitating careful consideration of the costs and benefits involved before initiating the license application process.

Obtain the CPA Gambling License

Obtaining an online gambling license from Kahnawake typically takes between 4 and 8 weeks. If, for any reason, the Commission rejects the application, a reimbursement of $10,000 is provided, while all other fees, including professional service fees, are non-refundable.

The initial step in the process involves applying for a Client Provider Authorization (CPA) license. The application form, along with other required documents, such as the license information form and personal information form, must be completed. Shareholders owning at least 10% of the business and key persons associated with the company are also required to submit these documents. For companies listed on stock exchanges, directors must provide a CV and annual reports from the past 3 years. The fee for a CPA license with the Kahnawake Gaming Commission is $25,000.

To obtain a license for Client Provider Authorization, applicants must provide the following information:

  • Business entity information form.
  • Personal information form (completed by individuals with 10% or more interest in the company).
  • Application for client provider.
  • A letter from Mohawk Internet Technologies expressing their willingness to host the applicant’s operations.
  • Control system submission.
  • Key person license application form.

The next step in the licensing process is ensuring compliance with ethical considerations. This includes implementing fair play policies, maintaining transparency, and confirming the absence of any criminal affiliations. Operators must also ensure they do not provide access to vulnerable user categories and take steps to guarantee data security and confidentiality.

Once the application and documents are submitted to the Kahnawake Gaming Commission, a decision is typically issued within 4 to 8 weeks. Initially, a six-month license is granted, during which the entity is continuously reviewed and tested.

After 12 months, the Kahnawake Gaming Commission conducts a final review to determine whether to issue a second license.

To expedite the license application process, it is advisable to engage a corporate service provider such as Szilaghi Consulting. Their expertise and familiarity with the Commission’s procedures can facilitate a faster and smoother application process compared to doing it independently.

The Kahnawake Gaming Commission and Other Regulatory Bodies

The Kahnawake Gaming Commission doesn’t work in isolation. Over the years, it has been working together with other regulatory bodies as well to make online gambling smoother and easier for players.

The Commission has been cooperating with the Financial Services Regulatory Commission of Antigua and Barbuda since 2004 when it entered into an agreement with this body through a memorandum of understanding.

The Kahnawake Gaming Commission also has a similar arrangement with the Lotteries and Gaming Authority of the Government of Malta through another such memorandum of understanding the two parties who entered in 2006.
