KSA’s advertising guide presented before the launch of Dutch igaming

The Dutch Gambling Regulatory Authority (KSA) launched the player advertising and recruitment guide ahead of the launch of the licensed online gambling market regulated by the Netherlands on 1 October.

This guide comes after the regulator received questions about the illegal targeting of gambling advertising to vulnerable groups, such as minors, and advertising featuring professional athletes and sports teams.

In accordance with Article 2 of the Netherlands Decree on the recruitment of gambling, advertising, and the prevention of addiction, the obligations of licensees prohibit them from targeting advertising to minors. KSA responded, noting that it will evaluate ads for content, placement, media presence, and target audience.

KSA also clarified that licensees are not allowed to include professional athletes or teams in their advertising. Also, as mentioned in Article 4 of the decree, famous influencers who are under the age of 25 and who have “substantial coverage” among young people cannot be used in advertising.

In August, the KSA fined the Lotto branch of the Nederlandse Loterij (NLO) EUR 10,000 for violating advertising codes of conduct. Moreover, the authority has published the reporting requirements to be met by all operators under the new Dutch gambling law.

The Dutch regulator began taking applications for an online gaming license in April, and the new licensed market is set to run on 1 October.
